Privacy Policy for the use of Instagram
As the operator of the Instagram profile (www.instagram.com/fuchsglobal/), we, FUCHS SE, Einsteinstraße 11, 68169 Mannheim, together with the operator of the photo and video sharing social network ‘Instagram’ Meta Platforms, Inc. (1 Hacker Way Menlo Park, California, CA 94025 USA) are controllers within the meaning of Article 4(7) of the General Data Protection Regulation (GDPR). When you visit our Instagram profile, personal data is processed by the controllers. In the following, we will inform you about what data is involved, how it is processed and what rights you have in this regard.
Instagram's privacy policy can be found at: https://privacycenter.instagram.com/policy/
As the controller of this site, we have entered into agreements with Instagram that, among other things, govern the terms and conditions for using the Instagram site. Instagram's terms of use apply.
1-a. Type of personal data, scope and purpose
When you visit our Instagram profile, we process your personal data when you interact with us (e.g. by liking, sharing, commenting on or saving one of our posts, sending us a message, following our profile). We then process the data you have published on your profile and your individual interaction with us.
Data about you can also be collected via our Instagram page through cookies, regardless of whether you have an account with Instagram or not. Cookies are data packages that mark the user's computers, smartphones and other end devices with a specific identifier. They are regularly stored on the user's end device when visiting an Instagram page, including this profile. The information stored in the cookies is received, recorded and processed by Instagram, in particular when the user visits the Instagram services, services provided by other members of the group and services provided by other companies that use the Instagram services. In addition, other entities such as Instagram partners or even third parties on the Instagram services may use cookies to provide services to companies advertising on Instagram. Instagram may change its cookie settings at any time. For more information about Instagram's use of cookies, please see their cookie policy and Instagram's cookie consent manager, which you can access through the privacy settings.
Above all, cookies are set to enable visitors to Instagram websites to view personalised advertising, for example. This is done by showing the user ads from Instagram advertising partners on our Instagram profile whose websites the user has previously visited. In addition, cookies enable us to compile statistics about the use of a social media profile so that we and Instagram can track the use of a social media profile.
1-b. Legal basis for data processing
The collection of your data by cookies when using the social media channel is not required by law or contract. Nor is it necessary for the conclusion of a contract. There is therefore no obligation to transfer your data to Instagram. However, if you do not transfer your data (e.g. by blocking cookies), we will not be able to offer you our social media channel, or only to a limited extent.
The legal basis for the use of technically necessary cookies for the associated storage of information on your end device and their subsequent reading is Section 25, paragraph 2, no. 2 TDDDG. The subsequent processing of your personal data is based on our legitimate interest in an optimised company presentation in accordance with Art. 6 (1) point f GDPR. We operate this Instagram page to present ourselves to and communicate with Instagram users and other interested persons who visit this Instagram page. If you block essential cookies, we may not be able to display our Instagram profile to its full extent.
Your consent is required for Instagram cookies that are not technically necessary. If you have given your consent to the use of a non-technically necessary cookie on the basis of a notice (‘cookie banner’) provided by Instagram, the lawfulness of the associated storage of information on your end device and its subsequent reading is governed by Section 25 (1) sentence 1 TDDDG. You can revoke this consent at any time for the future by deactivating cookies in your browser settings or in the cookie consent manager, which you can access via the privacy settings. The subsequent processing of your personal data is based on your explicitly granted consent in accordance with Art. 6 (1) point a GDPR. You can also revoke this consent at any time by deactivating cookies in your browser settings or in the cookie consent manager for the future.
2. Data transmission
In connection with the use of our social media profile, personal data may be transferred to countries outside the EU/EEA, in particular to the USA. The provisions of the GDPR do not apply in the USA. However, we take the necessary precautions in accordance with the provisions of the GDPR to ensure that your data is transferred in accordance with data protection regulations.
Since 10 July 2023, a so-called EU adequacy decision has been in force for the USA (EU-US Data Privacy Framework), legitimising US companies that have committed to appropriate data protection standards with the US Department of Commerce. US companies that have not done so are treated the same as other companies worldwide outside the European Union, unless there is an EU adequacy decision for the respective country. At FUCHS SE, we only work with companies for which the legally required measures have been taken to ensure that your data is transferred to these countries in a lawful manner. If there is no adequacy decision for a third country, compliance with the required level of data protection is usually ensured by concluding standard contractual clauses and implementing additional measures.
3. Nature of joint responsibility
The joint responsibility means in particular that you can submit requests for information and assert further data subject rights with the respective provider as well as with us. However, it makes sense to submit these requests directly to the providers. This is because the social network providers alone have direct access to the necessary information and can also take any necessary measures and provide information directly. However, should you require our assistance, we can be contacted at any time.
Further information about our contact details and the rights of data subjects can be found in the FUCHS SE privacy policy.
